These Terms of Service ("Terms") govern your access to and use of the mobile applications, websites, and services operated by TapCorp LLC ("TapCorp," "we," "us," or "our"), including the YouGotBail defendant application and the YouGotBail bondsman application (collectively, the "Services").
Please read these Terms carefully. By creating an account or using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.
You must be at least 18 years of age to use our Services. By using our Services, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into a binding agreement.
Our Services are intended for use within the United States only.
TapCorp operates a technology platform that enables defendants and individuals in need of bail assistance to connect with licensed bail bondsmen. The Services include:
TapCorp is a technology platform only. We are not a bail bond agency, bail bondsman, surety company, or insurance provider. We do not provide bail services, legal advice, or financial advice. We do not guarantee that a bondsman will respond to any alert, or that bail will be arranged within any particular time frame.
To use our Services, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.

We reserve the right to terminate accounts that contain false or misleading information.
By registering as a bondsman on our platform, you represent and warrant that:
TapCorp reserves the right to require proof of licensing at any time and to immediately terminate access to the bondsman application for any user who cannot demonstrate valid licensure. TapCorp is not responsible for verifying the licensing status of bondsmen on the platform — that responsibility lies entirely with the bondsman.
Licensed bondsmen may purchase zip code territories through the bondsman application. By purchasing a territory, you gain the right to receive bail alerts originating from that zip code area.
Territory pricing is set at the rate displayed in the application at the time of purchase and is subject to change with 30 days' notice.
Territories are billed on a monthly recurring basis through Stripe. By purchasing a territory, you authorize TapCorp to charge your payment method on file on a recurring monthly basis until you cancel.
All territory subscription payments are non-refundable once a billing period has begun. If you cancel a territory, you will retain access through the end of the current billing period, after which the territory will be released and made available to other bondsmen.
You may cancel a territory at any time through the Territories section of the bondsman application. Cancellation takes effect at the end of the current billing period.
Each zip code territory may only be held by one bondsman or agency at a time. Once a zip code is purchased, it is unavailable to other bondsmen until it is cancelled or lapses. TapCorp makes reasonable efforts to enforce this exclusivity but does not guarantee uninterrupted exclusive coverage in the event of system errors or edge cases.

Violation of these acceptable use provisions may result in immediate account termination without notice or refund.
The defendant application requests access to your device's precise GPS location for the purpose of routing bail alerts to the nearest available bondsman. By enabling location access, you consent to the transmission of your GPS coordinates to TapCorp's servers and to the bondsman responding to your alert at the time you trigger an alert.
Location data is not collected continuously. It is only transmitted at the moment you trigger a bail alert.
TapCorp does not guarantee that:
The availability and response time of bondsmen on our platform depends on factors outside TapCorp's control, including bondsman availability, geographic coverage, device connectivity, and system performance. TapCorp is not liable for any consequences resulting from a delayed, missed, or unacknowledged alert.
Payment processing for zip territory subscriptions is handled by Stripe, Inc. By using our paid services, you agree to Stripe's Terms of Service available at stripe.com/legal. TapCorp does not store your credit card number or payment credentials. All payment data is processed and stored by Stripe in accordance with PCI-DSS standards.
All content, features, and functionality of the TapCorp Services — including but not limited to the applications, code, design, text, graphics, logos, and trademarks — are owned by TapCorp LLC and are protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to use our applications for their intended purpose. This license does not include the right to copy, modify, distribute, sell, or sublicense any part of our Services.
Our Services integrate with third-party services including Stripe, Twilio, Firebase, Google Maps, and Apple Push Notification Service. Your use of these third-party services is governed by their respective terms of service and privacy policies. TapCorp is not responsible for the practices or content of any third-party service.
TapCorp LLC operates two distinct SMS notification programs under the YouGotBail platform. Each is described separately below.
Program name: YouGotBail SMS Alerts, operated by TapCorp LLC.
Description: YouGotBail is a bail alert platform connecting defendants with licensed bail bondsmen. This program delivers transactional SMS messages to registered app users:
Opt-in consent: By completing account registration in the YouGotBail app and checking the optional SMS consent checkbox, you consent to receive messages under this program. Consent is not required to use the platform or make any purchase. A reference of this opt-in flow is available at tapcorpllc.com/sms-opt-in.
Message frequency: Varies based on bail alert activity in your account or subscribed territory.

Program name: YouGotBail Emergency Contact Notifications, operated by TapCorp LLC.
Description: This program delivers one-time public safety notifications to individuals listed as emergency contacts by a registered defendant. Recipients are not required to be registered YouGotBail users.
Opt-in: Emergency contacts are identified by a registered defendant during app onboarding. The defendant provides your name and phone number and represents that they have your authorization to do so. Every message sent to emergency contacts includes opt-out instructions.
Message frequency: Maximum of two (2) messages per defendant listing — one welcome notification and one bail alert notification if triggered. No further messages are sent.

You agree to indemnify, defend, and hold harmless TapCorp LLC and its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:
You may delete your account at any time using the "Delete account" option in the application settings. Upon deletion, your profile and personal data will be removed as described in our Privacy Policy.
TapCorp reserves the right to suspend or terminate your account at any time, with or without notice, for:
Termination of your account does not entitle you to a refund of any subscription fees paid.
These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. To the extent that any dispute is not subject to arbitration under Section 18, you consent to the exclusive jurisdiction of the state and federal courts located in Martin County, Florida.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
You and TapCorp agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Services — including any question about their existence, validity, or termination — shall be resolved exclusively through binding individual arbitration, rather than in court.
The arbitration shall be conducted by JAMS under its Streamlined Arbitration Rules and Procedures. The arbitration shall take place in Martin County, Florida, or by telephone or video conference at the discretion of the arbitrator. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Either party may seek emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration. Claims for amounts less than $10,000 may be brought in small claims court in Martin County, Florida.
You may opt out of this arbitration agreement by sending written notice to privacy@tapcorpllc.com within 30 days of first accepting these Terms. Your notice must include your full name, email address, and a clear statement that you are opting out of arbitration.
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and notify you through the application or by email. Your continued use of the Services after any changes constitutes acceptance of the updated Terms.
If you do not agree to the updated Terms, you must stop using the Services and may delete your account.
If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and TapCorp with respect to the Services and supersede all prior agreements, understandings, and representations.
